1. Who is responsible for your data
The controller of the personal data collected on this website is AGRIFROST S.A.C., taxpayer number (RUC) 20614932245, with address at Calle Luis Arias Schreiber 192, Int. 202, La Aurora, Miraflores, Lima, Peru, Peru (“Agrifrost”, “we”).
For any question about this policy or your data, write to gurbina@agrifrostperu.com.pe.
2. What data we collect
Inquiry form: name, work email, company, country, products of interest, the content of your message, the page you sent it from and the language of the site.
WhatsApp: if you contact us through WhatsApp, the data you share there is processed by WhatsApp (Meta) under its own terms, and by us to answer you.
Analytics: only if you accept analytics cookies, aggregated data about your visit (pages viewed, device type, approximate country). See section 8.
3. Why we use it and on what legal basis
To answer your inquiry and prepare quotes: steps taken at your request before entering into a contract (GDPR art. 6(1)(b)) and your consent (Peru, Law 29733, art. 5 and 13).
To keep a record of commercial contacts and follow up on them: our legitimate interest in managing business relationships (GDPR art. 6(1)(f)).
To measure website use: your consent, which you can withdraw at any time (GDPR art. 6(1)(a)).
4. Who we share it with
We do not sell your data. We use service providers that process it on our behalf: Google (Google Sheets and Gmail, to receive and store inquiries), Vercel (website hosting) and, if you accept, our analytics provider.
Some of these providers are located outside Peru and the European Economic Area, including the United States. These transfers rely on the providers’ standard contractual clauses or the EU-US Data Privacy Framework, and on the guarantees required by Peruvian law for cross-border flows.
5. How long we keep it
Inquiries are kept for as long as needed to answer them and manage the resulting commercial relationship, and for a maximum of [TODO] after the last contact, unless the law requires longer.
6. Your rights
Under Peruvian law you have the rights of access, rectification, cancellation and objection (ARCO rights). Under the GDPR you also have the rights to restriction of processing, data portability and to withdraw consent at any time.
To exercise them, write to gurbina@agrifrostperu.com.pe indicating your request. We answer within the legal deadlines.
If you are not satisfied, you can file a claim with Peru’s National Authority for Personal Data Protection (Ministry of Justice and Human Rights) or with the data protection authority of your EU country of residence.
7. Personal data bank
The data from the inquiry form is stored in a personal data bank registered with the National Register for the Protection of Personal Data under number [TODO].
8. Cookies
This site only uses the technical storage needed to remember your language and your cookie choice. Analytics cookies are set only if you click “Accept analytics”. You can change your choice at any time from “Cookie settings” in the footer.
9. Security
The site is served over HTTPS and access to stored inquiries is restricted to Agrifrost staff who need it to answer you.
10. Changes
We may update this policy. The date at the top shows the latest version.
